1. Acceptance
By accessing or using wingies.app (the "Platform"), you ("User", "you") agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.
2. About Wingies
Wingies is an online intermediary platform operated by Pranayan Metiya, an individual, operating as "Wingies" under the laws of India ("Wingies", "we", "us"). The Platform allows individuals to (a) post listings for shared accommodation in Bengaluru ("Listers") and (b) discover and request contact with Listers ("Seekers").
Wingies does not:
- own, lease, manage, inspect, or visit any property;
- act as a real-estate broker, agent, sub-agent, property dealer, or property manager;
- verify the identity, eligibility, financial standing, or representations of any User;
- verify the accuracy, legality, ownership, or condition of any listed property;
- mediate, escrow, hold, or process any payment between Users;
- guarantee the accuracy, legality, or continued availability of any listing;
- guarantee the outcome of any contact, communication, or arrangement between Users.
Wingies is a passive facilitator and qualifies as an "intermediary" under §2(1)(w) of the Information Technology Act, 2000 ("IT Act"), entitled to the safe harbour under §79 of the IT Act.
3. Eligibility
You must (a) be at least 18 years of age, (b) be legally competent to contract under the Indian Contract Act, 1872, and (c) be an Indian resident. By using the Platform, you represent that you meet these requirements.
4. Account
- Sign-in is via your email address using a one-time login link. You are responsible for keeping your email account secure.
- You agree to provide accurate information during onboarding (name, WhatsApp number).
- You may not create multiple accounts to circumvent platform limits (e.g. credit grants, listing caps).
- We may suspend or terminate accounts at our sole discretion if we believe these Terms have been violated.
5. User-Generated Content
You retain ownership of content you post (listings, photos, descriptions, profile information). By posting, you grant Wingies a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and distribute that content for the limited purpose of operating the Platform. We do not grant ourselves rights to use your content for advertising, AI/ML model training, or any purpose other than operating Wingies.
You represent and warrant that:
- you have the right to post the content (including any photos);
- the content is accurate and not misleading;
- the content does not infringe any third party's rights or violate any law;
- you are not a real-estate broker, dealer, agent, or commercial operator posting on behalf of multiple properties as a business activity.
6. Credits
- Credits are a non-monetary in-platform mechanism that lets Seekers request a Lister's contact details. Credits have no cash value, are not transferable, are not redeemable for money, and are not refundable except as expressly provided.
- New users receive 10 signup credits. Listers receive 5 additional credits per listing posted. Users with a balance below 3 receive a weekly top-up.
- A contact request consumes 1 credit. If the Lister does not approve within 24 hours, the credit is automatically refunded.
- We may withdraw, suspend, or adjust credit balances if we detect fraud, abuse, or violation of these Terms.
7. Prohibited Conduct
You agree not to:
- post listings for properties you do not personally reside in, own, or have a stake in (no broker spam);
- post on behalf of paying-guest accommodations, hostels, co-living chains, or commercial PG operations;
- impersonate another person or misrepresent your identity;
- post content discriminating on the basis of religion, caste, ethnicity, or disability;
- post content that is unlawful, obscene, defamatory, hateful, harassing, threatening, or invasive of privacy under Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
- collect contact information of other Users through automated means (scraping, bots);
- attempt to bypass the contact-reveal mechanism or its credit cost;
- use the Platform to defraud, deceive, or harm another User.
Wingies uses best efforts to detect and remove broker, commercial-operator, and fraudulent listings, but makes no warranty as to the accuracy or completeness of such detection.
8. Intermediary Status, Takedowns & Grievance Redressal
Wingies acts as an intermediary under the IT Act and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("Intermediary Rules").
- We do not pre-screen User content but may review and remove content reactively, including upon receipt of a valid complaint or court/government order.
- Unlawful content under Rule 3(1)(b) of the Intermediary Rules will be removed within 36 hours of receipt of a valid notice; content described in Rule 3(2)(b) (non-consensual intimate imagery) within 24 hours.
- Grievance Officer: Pranayan Metiya, reachable at grievance@wingies.app. Physical address available on written request to the same email. The Grievance Officer will acknowledge complaints within 24 hours and resolve them within 15 days, in accordance with Rule 3(2)(a).
- Users may also escalate to the Grievance Appellate Committee constituted under the Intermediary Rules.
9. Disclaimers and User Verification Burden
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. To the maximum extent permitted by law, Wingies makes no warranty:
- that listings are accurate, current, lawful, or genuine;
- that Listers or Seekers are who they claim to be;
- that any property is fit for habitation, safe, available, or capable of being lawfully sublet on the terms stated;
- that the Platform will be uninterrupted, error-free, or secure.
You are solely responsible for independently verifying any Lister's identity, the existence and condition of any property, ownership or right to sublet, and for conducting any background or reference checks before any in-person meeting, payment, deposit, lease, or arrangement.
Any in-person meeting, agreement, lease, deposit, payment, or arrangement between Users is solely between those Users. Wingies is not a party to any such arrangement, does not act as a witness or guarantor, and bears no responsibility for its outcome.
10. Limitation of Liability
To the maximum extent permitted by law, in no event shall Wingies, its operators, employees, or agents be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, goodwill, or property, arising out of or related to your use of the Platform.
Wingies' aggregate liability to any User for any and all claims shall not exceed the greater of (a) the total fees paid by that User to Wingies in the twelve (12) months preceding the event giving rise to the claim, or (b) ₹1,000.
11. Indemnity
You agree to indemnify and hold Wingies harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from (a) your content, (b) your use of the Platform, (c) your interactions or arrangements with other Users, or (d) your violation of these Terms or any applicable law.
12. Termination
You may stop using the Platform at any time. We may suspend or terminate your account for violation of these Terms, suspected fraud, or where required by law. Sections 5 (licence), 9–11 (disclaimers, liability, indemnity), and 13 (governing law) survive termination.
13. Governing Law, Pre-Dispute Negotiation & Jurisdiction
These Terms are governed by the laws of India.
Before initiating any legal proceedings, the parties shall attempt to resolve the dispute through good-faith negotiation for a period of at least 15 days, beginning when one party notifies the other in writing of the dispute.
Any dispute not resolved within that period shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email or a notice on the Platform. Continued use after the effective date constitutes acceptance.
